Contract

This agreement contains the entire understanding between the Videographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, please put a check mark by each term:

Reservations:

Upon your signature, the videographer will reserve the time and date agreed upon. For this reason, the Reservation Deposit is non-refundable, for any reason. The Reservation Deposit must be paid at time of signing the contract. The Reservation Deposit is applied towards the contracted Short Form Videography Package.

Client understands and agrees that the entire amount owed for the Short Form Videography Package described in the contract is due on the day of the shoot. Client agrees if the balance is not paid by this time, the videographer will not shoot for the Client, with a loss of Reservation Deposit by Client and no liability to the Videographer.

Shooting Time:

The Client and the Videographer agree that co-operation and punctuality by both parties are essential. Shooting commences at the scheduled start time agreed by both parties. Should additional videography, or time, that is not included in the agreed package, be requested by the Client, it will be charged out at the rate of $250 per hour, rounded to the nearest half hour.

Copyright:

All the works, styles, ideas, products, and output developed in whole or in part by theVideographer in relation to the Services shall be owned by the Client, However, the copyrightownership shall be with the Videographer until final payment is made where such copyright ownership will partially be transferred to Client with the following rights:

1-Client hereby grants the Videographer and its heirs, assigns, and legal representatives the irrevocable and unrestricted right to use and publish videos of the client or in which the client may be included, for editorial, trade, advertising, or any other purpose. 2-Client may copyright the video. 3-Videographer may use excerpts of the video created for portfolio and advertising purposesof their services unless an agreement is made separately.

Performance of Services:

Videographer shall provide filming and editing services for the Client, producing with standardquality videos which shall be delivered on the agreed upon date. Videographer shall capture theshots requsted by the Client to the best of their abilities. The final product shall be delivered indigital format via google docs as agreed above.

Videographer is limited by the guidelines of the location requsted by the Client. As such, Clientagrees to accept the results made by the Videographer.

Videographer will not perform in an event that would in any case damage their equipment. Ifweather conditions prohibit video recording on the shoot day, either in part or in whole andarrangements have not been made to move indoors, the payments made shall not be refundable.

Completion Schedule:

The Client agrees that no part of the Short Form Videography Package, including previews (if any) will be delivered until the Outstanding Balance is paid in full. Digital copies will be given to the Client after, in the form of Google docs, assuming the Outstanding Balance has been paid in full, on the date agreed upon by both parties.

Payment:

The Client agrees that the Reservation Deposit is required at the time of signing the contract and the Outstanding Balance ("Day Of" payment) is due on, or before, the day of the shoot. All payments must be made to benncphotography@gmail.com.

Limit of Liability

In the unlikely event of severe medical, natural, or other emergency it could be necessary to retain a different videographer. The videographer will make every effort to secure a skilled replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the Short Form Videography Package, except the deposit.

In the unlikely event the video files have been lost, stolen, or destroyed for reasons within or beyond the Videographer’s control, the Videographer’s liability is limited to the return of all payments received for the Short Form Videography package, except deposit. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost.
